Form I-9 – Employment Eligibility Verification is the document that USCIS requires employees to fill out to verify their identity and authorization to work in the United States. All employees whether they are a U.S citizen, U.S national, or U.S resident alien are mandated to file this form.

An employee who started working must file and furnish this USCIS form to his or her employer within three days after the start of the employment. If Form I-9 isn’t given to the employer by the given time period, the employee and the employer will be subject to monetary penalties during an USCIs inspection. So the employer must obtain the I-9 of the employee and documents that prove identity and work authorization.

The following documents can be used for identity and work authorization verification.

Both Identity and Authorization to Work

  • Federal States of Micronesia Passport (must have Form I-94 or I-94A)
  • Foreign Passport with I-551 Stamp
  • Form I-766 (must have a photograph)
  • Permanent Resident Card (Green Card)
  • Republic of the Marshall Islands Passport (must have Form I-94 or I-94A)
  • U.S. Passport Book
  • U.S. Passport Card

Identity Only

The following documents can be used for establishing identity only.

  • Canadian Driver’s License
  • Driver’s License
  • Federal ID Card
  • Local ID Card
  • Military Dependent’s ID Card
  • School ID (must have a photograph)
  • State ID Card
  • U.S. Coast Guard Merchant Mariner Card
  • U.S. Military Card
  • Voter’s Registration Card

For employees under the age of 18, the following documents can be used for identity.

  • Clinic Record
  • Day-care Record
  • Doctor Record
  • Hospital Record
  • Nursery School Record
  • School Record Report
  • School Report Card

Authorization to Work Only

  • Certification of Report of Birth issued by the Department of State
  • Certified Copy of Birth Certificate issued by a State or County
  • Employment Authorization Document issued by the Department of Homeland Security
  • Form I-197
  • Native American Tribal Document
  • Original Birth Certificate
  • U.S. Citizen ID Card
